These Terms & Conditions ("Terms") govern your access to and use of the BrightPathSchooling website, applications, and related services (collectively, the "Service") provided by Bright Path schooling ("we", "us", "our", or the "Seller"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who you are contracting with
You are entering into a contract with Bright Path schooling. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you are an individual, you represent that you are of legal age to form a binding contract in your jurisdiction.
2. The Service
BrightPathSchooling is an AI-assisted homeschooling platform that provides curriculum-aligned lessons, adaptive quizzes, parent analytics, and related features for families in Canada and the United States. Features, subjects, and content may change over time as we improve the Service.
3. Accounts and accurate information
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and current information and to keep it up to date. Notify us promptly of any unauthorized use of your account.
4. Acceptable use
You must not misuse the Service. In particular, you agree not to:
- use the Service for any unlawful, fraudulent, or harmful purpose;
- send spam, malware, or otherwise interfere with the security or integrity of the Service;
- probe, scan, scrape, or test the vulnerability of the Service or any related system;
- infringe any intellectual property, privacy, or other rights of any third party;
- attempt to reverse engineer, decompile, or circumvent any technical limits of the Service;
- resell, sublicense, or redistribute the Service or its content without our written consent.
5. AI-generated content
Portions of the Service use generative AI to produce lessons, quizzes, and recommendations. You are responsible for how you and your children use these outputs, for verifying accuracy where it matters, and for ensuring you have rights in any content you submit as input. AI-generated outputs may contain errors and are not a substitute for professional educational, medical, legal, or financial advice. We may moderate, filter, restrict, or remove content and may suspend accounts that repeatedly violate these Terms. We will act on good-faith takedown requests from rights holders and may terminate repeat infringers.
6. Intellectual property
We (and our licensors) retain all right, title, and interest in and to the Service, including software, content templates, branding, and documentation. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service within your subscription plan for personal, non-commercial homeschooling use. Any content you submit remains yours; you grant us a limited licence to host and process it solely to provide the Service.
7. Payments, subscriptions, and taxes
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Subscription pricing, billing frequency, renewals, cancellations, refunds, taxes, and payment methods are governed by Paddle's Buyer Terms and our Refund Policy.
Subscriptions renew automatically at the end of each billing period until cancelled. You may cancel at any time; see our Refund Policy for how refunds are handled.
8. Suspension and termination
We may suspend or terminate your access to the Service, with or without notice, for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. On termination, your right to use the Service ends immediately; we may delete account data after a reasonable period.
9. Service level and warranties
We work hard to keep the Service available, but we do not guarantee that it will be uninterrupted, timely, secure, or error-free. To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service will not exceed the fees you paid to Paddle for the Service in the twelve (12) months preceding the event giving rise to the claim. We will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited under applicable law (for example, fraud or death or personal injury caused by negligence).
11. Indemnity
You agree to indemnify and hold us harmless from any claims, damages, or costs arising from your content, your use of the Service in violation of these Terms, or your violation of applicable law or the rights of others.
12. Governing law and disputes
These Terms are governed by the laws of the Province of Alberta, Canada, without regard to conflict-of-laws principles. The courts located in Alberta will have exclusive jurisdiction over any dispute, subject to any mandatory consumer protections in your country of residence.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes we will notify you through the Service or by email. Continued use after the changes take effect constitutes acceptance of the updated Terms.
